Rule 5
Imprisonment suspended
(1) According to section 24 of the Act, when the court suspends the prison sentence of the offender, it shall be mentioned in the judgment.
(2) When ordering the suspension of imprisonment in accordance with sub-rule (1), an officer shall also be appointed to monitor whether the offender complies with the conditions mentioned in sub-section (4) of section 24 of the Act during the period of suspension.
(3) When appointing the monitoring officer according to sub-rule (2), the court may appoint the Tehsildar or other agency or officer.
(4) The officer assigned to monitor according to sub-rule (3) may do the following while monitoring the offender:-
(a) The monitoring officer himself to monitor or to order the local level or any other body to monitor and submit a report to the court regularly,
(b) compel the offender himself to submit a report to the court from time to time.
(5) According to sub-rule (4), the officer assigned responsibility for monitoring should submit a report to the court to cancel the order to suspend the prison sentence if it is found that the offender does not comply with the prescribed conditions during the monitoring.
(6) According to this rule, if there is an order to suspend the prison sentence imposed on the offender or if the order to suspend the prison sentence is revoked, such suspended sentence should also be mentioned in the book along with the fine.
